General Regulation 18: Copyright
HE licences exist to permit the distribution of copyright material by the university to its students for educational purposes, in addition to the provisions made in the CDPA for copying for study and research known as "fair dealing" and for education.
All use of copyright materials must be in accordance with the College's Copyright Licences, and copyright law including the Copyright Designs and Patents Act (CDPA) 1988 and subsequent amending legislation, the EU Copyright Directive 2001/29/EC, implemented in the UK in 2003. Records are returned to and periodically audited by the Licensing Agencies in order that royalties are paid to copyright holders. The Designated Licencing Co-ordinator in the Library is responsible for the return of these records and can provide advice on the Licences held.
Copyright Licences:
- CLA Higher Education UUK/GuildHE Comprehensive Licence
- Newspaper Licencing Agency (NLA) Licence
- Educational Recording Agency ERA Plus Licence with BUFVC membership

VLE and teaching
Scans and digital copies from books and journals for the VLE - If you want to use copyright material from books or journals in the VLE, you must first request the scan or copy from the Goldsmiths Digital Copy service provided by the Library and ITS. This is a quick, efficient, high-quality service and you can make a request online with the Goldsmiths Digital Copy Request form. If the item is covered by the licence, the scan will be made and sent to you to upload into the VLE. If the items is not covered by the licence, you will be informed and individual permission may be sought.
For book and journal material, scans are provided from the library to comply with the terms of the CLA Comprehensive Licence which permits Designated Persons to make a scan or a digital copy of material owned by Goldsmiths and covered by the Licence, for re-use in the VLE. Some publishers and types of materials are not covered by the licence and different conditions apply for e-journals so careful checks need to be made, and records must be kept.
Photocopying for Course Packs, from Design & Print Services - copyright material for use in course packs must either be covered by the CLA Licence, or you must have permission to copy and distribute it for that purpose. If you have been provided with a digital copy for use in the VLE by Goldsmiths Digital Copy above, you may provide that file to Design and Print to produce a single paper copy for students on the specific course.
The Educational Recording Agency (ERA) Plus licence permits recordings of broadcasts to be made for non-commercial educational use. This includes scheduled radio, television and free-view broadcasts, but not pay per view broadcasts. These recordings may then be communicated to registered students in the UK, using an authenticated access system. Other conditions apply, see the licence or JISC Digital Media Audiovisual Copyright FAQs for guidance.
Box of Broadcasts (BoB)
BoB is an off-air recording and media archive service which is available to staff and students of member institutions of the British Universities Film & Video Council that hold an ERA+ license. This TV scheduling service allows you to record TV and radio programmes that are scheduled to be broadcast over the next seven days as well as retrieving programmes from the last seven days from a selected list of recorded channels. You also have access to an extensive archive. BoB material can then be accessed on the web by a streaming service similar to iPlayer and can be embedded in the VLE for access within the UK. Goldsmiths had trial access to 18 September 2011, more news to follow.
Fair dealing and educational provisions
Making individual copies of many kinds of material for study or research are covered by the CDPA provisions for "fair dealing".
The CDPA also makes some provisions for educational use. Exceptions and conditions apply depending on how material is to be used and the source, so please check the resources below or ask for advice.
If you want to copy moving image and film or sound recordings and are not sure how copyright applies to what you intend to do, please seek advice as this is a complex area.
Creative Commons and copyright-free material
There are many resources available which can be shared, remixed and re-used legally, use Search at Creative Commons (cc) to find some, or see JISC Digital Media below to find out more. You can attach a Creative Commons licence to work you publish on the internet to indicate you are happy for it to be re-used in certain way (see: http://creativecommons.org/license/|).
GRO - Goldsmiths Research Online
The repository GRO shows research by academics at Goldsmiths. Some research outputs such as journal articles may be made Open Access, if the author or creator owns the copyright, or has permission from the copyright owner, often the publisher, to make their work available to the public in this way. You can check publishers' policies on open access by self-archiving using ROMEO.

Copyright Licensing Agency (CLA) . User Guidelines for the HE Licence are available from the CLA website. Note that a number of publishers have refused to participate with respect to certain titles, therefore these titles are not covered by the licences. Use of e-journals is opt-in, rather than opt-out. Lists of exclusions for copying and inclusions for e-journals are available on the CLA website.
