The Case of Windrush

This discussion aims to unpack the tools designed to rectify the case of Windrush, a series of Home Office policies that, since the 1960’s, have gradually been restricting the rights of Commonwealth citizens to live and work in the United Kingdom (UK) leading to unlawful detention and deportation. Through the frame of community-run legal surgeries set up by guest speakers Anthony Brown and Jacqueline McKenzie, this discussion will first explore the calculus of the Windrush Scheme through which over 2,000 people have attained British Citizenship, although 1,501 applicants have been refused. As independent advisor to the Home Office in the construction of the UK Government’s ‘Compensation Scheme’, Martin Forde QC will then walk through the design process of his recommendations, in response to reports that just £62,198 has so far been paid in compensation out of a pot said to hold between £200m and £570m. The practitioners will each speak on this current framing of justice, in order to explore how the legal, social and political contours of this case intersect with ideas of race. The discussion will also respond to a pamphlet created for this event, a practice aimed to develop alternative media channels to connect key groups, ideas and institutions in the formation of justice.
